Background -
Over the past ten years, the State Attorneys’ Offices throughout Florida have tried to curtail “domestic violence” by increasing sanctions imposed on the defendant in an attempt to protect the victim.    Based on statistics, their efforts have worked - the total number of reported domestic violence cases between 1997 and 2006 have decreased.    Domestic violence crime includes murder, manslaughter, rape, sodomy, aggravated assault, aggravated stalking, and simple assault.  Many state attorneys’ offices have designed special domestic violence units to manage domestic violence cases.  Some units, referred to as ‘victim units’ are staffed by counselors who provide assistance to victims and help them cope with their abuse.

Arrested for Domestic Violence -
If someone you know has been arrested for a domestic violence crime, it is very likely they are being held in custody with no bond.   To be released, the person will appear before a First Appearance Judge within 24 hours of being arrested.   The First Appearance Judge has the discretion to issue a bond amount, set any conditions of release (such as no contact with the victim) or deny a bond.   If you, or someone you know, is released on bond, it is imperative that you comply with the Judge’s Order.  A violation of the Judge’s Order could result in further incarceration and an additional criminal charge.
